The Income Tax Department has released ITR-1, ITR-3, ITR-4, and ITR-5 forms for the assessment year 2025-26. Income tax payers can now file their ITR returns by choosing either the old tax regime or the new tax regime. The new tax regime has been made the default. Therefore, it is mandatory for many of the taxpayers who want to file ITR by adopting the old tax regime to fill Form 10-IEA.
Form 10-IEA is a declaration form. If you come from the Hindu Undivided Family (HUF), Association of Persons (AOP), Body of Individuals (BOI), or Artificial Juridical Persons category and your income is from business or profession and you want to file ITR by choosing the old tax regime, then you have to submit this form.
These people don't need to fill Form 10-IEA
People who earn from salary or pension and whose income does not have any role in business or profession do not need to fill this form. Such taxpayers can deposit income tax by simply selecting the option of the Old Tax Regime while filing an Income Tax Return (ITR). Those for whom this form is mandatory, if they do not fill it out before the ITR deadline, then they will not get the benefit of exemptions and deductions available under the old tax system.
How to fill Form 10-IEA?
Those whose income is from business or profession will have to file returns through ITR-3 or ITR-4 and also fill Form 10-IEA. While filling the form, the following information has to be given-
Name (as per PAN card)
Assessment year (e.g., AY 2025-26 for FY 2024-25)
Are you coming out of the new tax regime or returning to it?
Is your income related to business or a profession?
Do you have a unit in IFSC?
Address, date of birth, type of business, previously filed Form 10-IE (if any), and a formal declaration will also have to be given.
