In Noida, home buyers in Mahagun Mirabella, located in Sector 79, have approached the Allahabad High Court for the registration of their flats regarding this issue. The registration of these home buyers has been pending for 6 years. A part of the Sports City project in Sector 78 and 79 was launched in 2011 with the promise of premium sports facilities. More than 500 families living in the society have paid from Rs 60 lakh to Rs 1.25 crore for their flats, but they say that they still cannot call it their home without papers.

Some of these home buyers bought flats around 2020-2022, they had paid around Rs 2 to 2.5 crore. Residents of this society said that they have paid the entire amount for their units to the builder and have also deposited the stamp duty amount to the revenue department, but the process of registration has not started yet. Ashok Vardhan, a petitioner in this case, said that several attempts to talk to the Noida Authority and government representatives failed, due to which there is disappointment and frustration among the residents.

The registry is necessary; take these steps in case of delay.

It is very important to get the registration done for both the house and the land. Because, without this, you are not considered a legal owner. In such a situation, neither can you sell the property nor take a loan. In such a situation, it is important to get the registration done on time, and in case of not getting it done, take these steps.

-If the builder gave possession but did not get the registration done, then you can complain about it to RERA (Real Estate Regulatory Authority).

-You can also file a case in the consumer court for registration.

-Send a legal notice to the builder or developer through a lawyer, asking them to get the registration done.

-If they are still not ready, then file a Specific Performance Suit in the civil court.

On the other hand, while hearing the petition of 65 home buyers of this Noida society, the High Court bench of Justice Manoj Kumar Gupta and Anish Kumar Gupta has issued notice to the Uttar Pradesh government, Noida Authority, the project developer, and Golfgreen Infra and sought a reply. It has given time to the Uttar Pradesh government and the Noida Authority to get instructions. The next hearing in this case will be held in the second week of July.
