Under this, the exchange of land (Badlain) done with mutual consent between two raiyats has got legal recognition. This change under the Bihar Special Survey and Settlement (Amendment) Rules 2025 will benefit thousands of farmers who have got possession of the exchanged land for years, but did not get any legal rights. After this decision of the Bihar government, now the raiyats will not have to visit the registry office repeatedly to exchange land. This new system will prove to be especially useful in rural areas, where traditionally land has been exchanged based on verbal consent.
Land exchange gets legal recognition
Jehanabad District Settlement Officer Upendra Prasad said that if the exchange of land between any two peasants has been done verbally and both are peacefully occupying that land, then in such a situation it will be considered valid. Not only this, if both the parties give their consent in writing at the time of survey, then in that situation their name will be recorded in the land rights record on that land and their account will also be opened on that basis. This decision will not only prove helpful to the farmers in getting their own land, but there is also a possibility of reduction in land related disputes. And in rural areas, legal processes will also become easier. It is known that work is already being done in Jehanabad in this matter.
Farmers' work will become easier
It is said that in earlier times, land exchange was very common, but there was no legal right. People used to exchange land as per their convenience, so that they could avoid registration fee and other procedures. However, in this situation, neither could they sell that land nor could anyone become its heir, but this government decision will now provide relief to all those farmers whose land is to be exchanged. Because it has got legal recognition. In such a situation, farmers can now take loan from the bank and can also buy and sell.
