One8 Commune, a popular pub and restaurant in Bengaluru owned by cricketer Virat Kohli, is in hot water once again. The establishment has been charged under Sections 4 and 21 of the Cigarettes and Other Tobacco Products Act (COTPA) for failing to designate a smoking area within its premises. The Cubbon Park Police initiated a suo-moto case regarding these violations. This incident marks yet another instance of legal action against One8 Commune, as an FIR was previously filed in June 2024 for operating beyond permitted hours.
Additionally, in December, the Bruhat Bengaluru Mahanagara Palike issued a notice to the restaurant for not securing a No Objection Certificate (NOC) from the Fire Department.
The Cigarettes and Other Tobacco Products Act (COTPA) was established in 2003 by the Indian government as a comprehensive law aimed at controlling tobacco use.
Key provisions of this Act include:
a) Section 4 prohibits smoking in public areas.
b) Section 5 bans advertisements for cigarettes and other tobacco products.
c) Section 6 restricts the sale of tobacco products to individuals under 18 years and in specific locations.
d) Section 7 forbids the trade and commerce of production, supply, and distribution of tobacco products.
