A historic decision has come for contract primary school teachers working in the Municipal Corporation of Delhi (MCD). The Central Administrative Tribunal (CAT) has ordered MCD to give equal pay to all its contract teachers under the 7th Pay Commission.

This decision has come up with great relief for thousands of teachers who were demanding equal pay for equal work while working on low salary for a long time. In this article, we will discuss the importance of this decision, its impact and its benefits for teachers in detail.

Cat’s historical decision and its basis

The bench of the Central Administrative Tribunal (CAT), which included judicial member Manish Garg and administrative member Rajendra Kashyap, clearly stated that the principle of equal pay for equal work should apply to all employees. The court argued that when contracts and regular teachers are discharging uniform duties, discrimination in their salary is unfair.

This decision has fulfilled the long -standing demand of contract teachers of Delhi Municipal Corporation. CAT also added that this inequality is not accepted in any way and all teachers should get justified salary based on their work.

What are the benefits of MCD teachers from 7th Pay Commission?

The order came in response to the petition of Shahnaz Parveen and Tahmina Riyaz, but it will benefit more than 1200 contract teachers working in MCD. These teachers will now be entitled to minimum pay scale, dearness allowance and other allowances under 7th Pay Commission.

The petitioners in their petition claimed that they were doing the same work as regular teachers, but they were getting very low salary. This decision will improve their economic condition and bring new energy in their work. This step will not only strengthen the financial position of teachers, but will also increase their confidence and inspiration.

Integration and salary amendment of MCD

After the integration of the Municipal Corporation of Delhi, this decision has become even more important. CAT clarified that the South Delhi Municipal Corporation amended the salary of its contract teachers in 2017, but did not get this benefit in other corporations.

Now integrated MCD will have to apply salary according to 7th Pay Commission for all contract teachers. As per the order, MCD will have to ensure salary payment within three months. If paid on time, interest will also have to be paid at the rate of General Provident Fund (GPF) on the outstanding amount.
