The Supreme Court of India has postponed the hearing in the case of Indian nurse Nimisha Priya, who is serving a death penalty in Yemen on Friday, July 18, till 14 August. With this, India has got additional time to carry forward diplomatic and legal efforts to prevent Nimisha’s hanging. On 16 July, his scheduled hanging was stopped after India’s intervention.
Nimisha Priya was sentenced to death on charges of killing a person in Yemen. It is said that the person was harassing him and Nimisha took this step in self -defense. According to the Sharia law applicable in Yemen, the family of the deceased has the right to pardon. Therefore, now the future of this case depends on the apology of the deceased Talal Abdo Mahdi’s family.
The Ministry of External Affairs (Mea) has confirmed that it is actively assisting Nimisha. The Ministry has appointed a lawyer who is working on options such as Yemeni legal process and potential psalcade or ‘blood money’. Since India has no diplomatic representation in Yemen’s Hooti-controlled region, the dialogue has been complicated.
During the hearing, representatives of the Government of India informed the Supreme Court that they want Nimisha to return to India safely. The government told the court that it is making all appropriate efforts and needs more time for this. Giving this time, the court fixed the next hearing on 14 August. On the other hand, the family of the deceased Mahdi has publicly said that they want justice, even if it is delayed. Although some intermediaries have tried to convince the family for pardon, but the family has not forgiven yet.
Meanwhile, the ongoing campaign to save Nimisha has gained further speed. A alliance of the Government of India, religious leaders, social organizations and lawyers is talking to the Yemen government and the Mahdi family. Now everyone’s eyes are on the next hearing of August 14 and India’s diplomatic efforts, on which the life of an Indian citizen rests.
