The Philippines has changed the rules about work permits for all foreign workers. On August 27, 2025, the Department of Labour and Employment (DOLE) published new guidelines to make the process clearer and faster for both employers and foreign workers.

Key Change: Job Vacancy Posting

Under the new rules, employers don’t have to put job openings on PhilJobNet or at the Public Employment Service Office (PESO) anymore for hiring foreign workers. The only thing they have to do is put the job opening in a newspaper that is read by a lot of people for at least 15 days.

Due to the change, businesses can now apply for an Alien Employment Permit (AEP) as soon as the publication period ends. Postings in newspapers are valid for 45 days. However, it is no longer required; DOLE still encourages employers to use PhilJobNet and PESO.

For renewals, an employer can submit an Affidavit of Undertaking to confirm they will comply with the publication rule.

Training Program Requirements

The new guidelines also clarify who needs to submit an Understudy Training Program (UTP) or a Skills Development Program (SDP). These apply only to:

  • Companies registered under the Foreign Investment Act that qualify for government incentives
  • Public utility operators
  • Businesses identified by the government as strategic investments

The UTP/SDP must be filed either at the time of the work permit application or within 60 days from the start of work. Reports are then required on a set schedule:

  • One-year work permits: report every six months
  • Two- to three-year work permits: report once a year

These reports must show the training progress and be signed by both the foreign and local workers involved.

It is worth mentioning that work permits issued before February 10, 2025, will only need a UTP/SDP at renewal.

Exemptions

Not everyone is covered by the UTP/SDP rules. Exempt groups include:

  • Workers are already exempt from needing a work permit
  • Company owners and investors with equity in the business
  • Other groups that may later be identified by the government’s technical working group

For these individuals, no training program submission is required, cutting down on paperwork and compliance steps.

Economic Needs Test

The Department of Labour and Employment (DOLE) will also create a technical working group to prepare a public report on the economic impact of hiring foreign nationals. Employers can use this report to better understand labour market conditions and guide their hiring decisions.
