The Supreme Court will hear in July the petition filed against the notice issued by the DDA to demolish houses and shops in Jamia Nagar, Okhla, Delhi. Earlier, in an order dated May 7, the Supreme Court had directed the DDA to take action as per law against unauthorized structures in an area of 2 Bigha 10 Biswa.

The Supreme Court on Monday announced that it will hear in July a petition filed against some alleged unauthorised constructions in the national capital’s Okhla village. The matter was presented before a bench of Justices Sanjay Karol and Satish Chandra Sharma. Senior advocate Sanjay Hegde, appearing for the petitioner, referred to the apex court’s May 7 order, which directed the DDA to demolish unauthorised constructions and encroachments in Okhla village in accordance with the law.
The bench said that they are aware of their orders and do not want to say anything in the matter, leaving it to Hegde whether to pass an appropriate order or defer it till July. Hegde requested that no action be taken in the meantime as this is the real problem. The bench remarked that this is their order and they understand the situation very well. The apex court asked Hegde to take instructions and adjourned the matter. When the matter came up for hearing again, the senior advocate requested to extend it till July.
The petitioner’s counsel referred to a paragraph of the Supreme Court’s May 7 order, which states that those affected by the demolition notice are free to take appropriate action in accordance with the law. Following this, the bench scheduled the hearing of the case in July.
In its order dated May 7, the apex court directed the DDA to take action to demolish the unauthorised structures situated in the 2 Bigha 10 Biswa area as per law. Along with this, the court also asked the DDA to file an affidavit of compliance within three months.
The apex court clarified that before demolishing any structure, it is necessary to give a notice of at least 15 days to the concerned persons. This remark was made when the court was hearing a contempt petition in the matter of violation of its instructions given in 2018 against large-scale encroachment and illegal construction on public land in Delhi.
Recently, the authorities have issued a notice to demolish several houses in Jamia Nagar, Okhla, Delhi due to encroachment on the land of the Uttar Pradesh Irrigation Department. In this notice dated May 22, it has been told that there are houses and shops built illegally on the land of the Irrigation Control Department in Okhla, Khijarbaba Colony, which have been directed to be demolished within the next 15 days.
