A rule has also been fixed for giving gratuity. The amount of gratuity (what is gratuity) is given to the employee as a reward for a better service record, while being regular in the company.


It is given by the company itself. This amount of gratuity (gratuity rules for employees) is not given to any employee during the job, but is definitely given after leaving the job or retirement. An employee gets gratuity (Gratuity rules) even after working for 7 years or 10 years.


This is how gratuity will be calculated -


The last salary of the employee is very important for deciding the amount of gratuity. On leaving the job or retiring (gratuity rules for employees), gratuity is calculated by considering the average salary of the last 10 months as the last salary. The number of years the employee has served in the company is multiplied by the last salary and calculated (gratuity calculation). After this, gratuity is decided by multiplying this calculation by 15/26.


Calculation of gratuity after working for 5 years-


If an employee leaves a company after working for 5 years and his last salary is Rs 35,000, then the amount of gratuity (gratuity rules) will be - 35000 x 5 x 15/26 = Rs 100961.


Gratuity after working for 10 years-


If he leaves the job or retires after working somewhere for 10 years, then the amount of gratuity (10-year gratuity rules) will be 75000 x 10 x 15/26 = Rs 432692 as per the last salary of Rs 75000. Similarly, you can calculate the gratuity amount for the other years of work.


Only 26 days of the month are included in gratuity-


While deciding the amount of gratuity, the 4 Sunday holidays (working days rule for gratuity) are not counted. Gratuity calculation (Gratuity kab milti hai) is done by counting the 26 days of the month.


Such employees do not get gratuity-


If an employee works for 4 years and 5 months and then leaves the job, he will not get gratuity (gratuity kisko milti h). Instead, if the job is done for 4 years and 7 months, then gratuity is given as per 5 years. That is, as soon as it is more than six months, that period (gratuity time limit) is counted in the whole year.


The company can stop gratuity-


Companies also have the right to stop the gratuity (gratuity rules) amount in special circumstances, but for this, evidence has to be given, and first, a show cause notice has to be issued to the employee. If the employee causes any major loss to the company, or it happens because of him, then the company can stop the gratuity.


This is the act regarding gratuity-


Under the Gratuity Act 1972, a company with at least 10 employees registered pays a gratuity (gratuity rules for employees) amount to the employee. If a company is not registered under the Gratuity Act, then the amount of gratuity (gratuity kaise milti h) of the employee is equal to half month's salary every year and working days in a month are considered to be 30.
