Traffic Rules: Can the traffic police take out the keys from your car? Know your rights and rulesTezzbuzz | 2025-01-26 13:24:09
Obnews Auto Desk: If a traffic police constable is taking out the keys from your car, then it is against the rules. The constable does not have the right to seize your vehicle or arrest you. Also, no traffic policeman can harass you without any reason. In such a situation you can take action against him. However, many people do not know this and by mistake get scared of the traffic police.
In fact, under the Indian Motor Vehicle Act 1932, only an ASI (Assistant Sub Inspector) level officer can issue a challan on traffic violation. ASI, SI, and Inspector have the authority to issue spot fines, while traffic constables are there to assist them.
You should keep these things in mind
Challan Book or E-Challan Machine: Traffic police should have a challan book or e-challan machine. If they don't have either of these things, your challan cannot be deducted.
Uniform: It is necessary for the traffic policeman to be in uniform, which should also have his buckle number and name. If they are not in uniform, you can ask them to show their identity card.
Fine limit: The head constable can impose a fine of only Rs 100. If the fine is more than this, then only the traffic officer (ASI or SI) can do it.
On taking out the car key: If the constable takes out the keys of your car, you can make a video of it and show that video to the senior police officer and file a complaint.
Documents: While driving, you should have the original copy of driving license, pollution under control certificate. Photocopies of vehicle registration and insurance can also be useful.
Payment of fine: If you don't have money on the spot, you can pay the fine later. In this situation, the court issues a challan, which you have to pay by going to the court. The traffic officer can keep your driving license with him.
